The patent suggest it could be either. I'm not sure the way they worded it.
so is this thing a automatic?
I've seen ppl post it will be a 5 speed standard, but can it also go auto? Cause I won't feel like shifting how/where I drive?

It's sounding like it could use a clutch to engage 1st gear and then auto from there.
Max rpm Clutch dumps in 4wd would be hell on the driveline but would be lots of fun. haha It would definitely get the jump on anything out there.
